Supreme Court granted special leave to appeal in a bribery case against former Minister of Finance Ravi Karunanayake on 17th May 2024 for accepting an apartment from Arjun Aloysius, a director of a primary dealer company. CIABOC filed this special leave to appeal application before the Supreme Court from an order of the Court of Appeal overruling a preliminary objection raised on behalf of the CIABOC that the accused has no right to appeal against an interim order of the High Court. In the High Court the accused raised the objection that he is not a ‘public servant’ in terms of the Bribery Act as the Constitution has excluded Ministers in the definition of ‘public officer’ in terms of Article 170 of the Constitution. The High Court overruled this objection and held that the accused is a public servant’ who can be indicted in terms of the Bribery Act.
